*The forced exile of the San Isidro Movement founder raises urgent questions about the legitimacy of Cuban artwork sales under state control and undocumented exports.*

Luis Manuel Otero Alcántara, the Cuban artist and activist who founded the San Isidro Movement, has arrived in Miami after being expelled from Cuba following a politically motivated prison sentence. His case exposes a critical problem for anyone who owns Cuban art purchased in the past decade: provenance documentation that may be worthless.

Alcántara was sentenced to five years in prison in June 2022 on charges of contempt, resistance, and public disorder. International human rights organisations including Amnesty International designated him a prisoner of conscience. His expulsion follows a pattern of the Cuban government forcing dissidents into exile rather than allowing them to remain after release, a tactic used against playwright Yunior García Aguilera in 2021 and multiple participants in the July 11, 2021 protests known as the 11J movement.

The San Isidro Movement advocates for freedom of expression and opposes Decree 349, the 2018 law that requires state approval for all cultural activities in Cuba. This decree has been used systematically to control independent artists, creating a situation where artwork sales may have occurred under duress or without the artist's genuine consent.

Here is the provenance problem. Cuban law restricts the unauthorised export of artwork. Any piece that left Cuba in recent years should have official documentation proving it was legally exported. Without that paperwork, the work may have been smuggled out, creating a legal nightmare for current owners. Even with documentation, if it was issued during a period when the artist was under state pressure or imprisonment, the legitimacy of the sale itself becomes questionable.

Alcántara engaged in multiple hunger strikes while imprisoned, drawing international attention to the crackdown on independent Cuban artists. His imprisonment coincided with increased prosecutions of artists for politically themed work, including the case of artist Hamlet Lavastida. Artist Tania Bruguera faced multiple detentions and travel restrictions between 2014 and 2021 for her performance art addressing political themes.

Miami, where Alcántara has now arrived, has historically been the primary destination for Cuban exiles and maintains the largest Cuban diaspora community. This pattern stretches back to the Mariel boatlift of 1980, which included artists and intellectuals. The city's galleries and private collections hold substantial amounts of Cuban art, some of it purchased through channels that may now be under scrutiny.

For collectors and institutions, the implications are immediate. If you own Cuban art purchased in the past decade, verify the provenance documentation. Look for evidence of legal export authorisation. Determine whether the artist was operating independently or under state control at the time of sale. In cases involving artists now in exile, contact them directly to confirm whether they authorised the sale and received payment.

The expulsion of a figure as prominent as Alcántara signals an escalation in Cuba's suppression of independent artistic voices. It also signals that any Cuban artwork that entered the market during this crackdown period carries heightened provenance risk. Works may have been sold under duress, exported illegally, or involve artists who now dispute the transactions entirely.

This is not a theoretical problem. When governments criminalise independent artistic expression and force artists into exile, the integrity of the entire market for that nation's contemporary art collapses. Authentication and provenance require the artist's participation. When the artist is in prison or exile, that participation becomes impossible or unreliable.

If you bought Cuban art recently, especially work by artists associated with the San Isidro Movement or other dissident cultural groups, you need to act. Request full documentation of the sale, export authorisation, and payment records. Understand that even apparently legitimate paperwork issued by Cuban state agencies may not reflect the artist's actual consent or involvement.

The arrival of Luis Manuel Otero Alcántara in Miami marks another chapter in Cuba's long history of exiling its artists. It also marks a warning for anyone holding Cuban art acquired during the period of his imprisonment and the wider crackdown on independent culture. Provenance that looked solid a few years ago may now be fatally compromised.
