Perm Skilled
Hi everyone—looking for guidance on my PERM Skilled Worker case. I received an ETA-9141 prevailing wage determination denial, and my lawyer filed an appeal. I’m anxious and would appreciate any insight.
**Denial reason (summary):**
The denial says I didn’t meet the employer’s requirements listed in **ETA-9141 Section F.b.1**. The employer requires an **Associate’s degree and 24 months of experience**, but the decision notes I have an Associate’s degree and **0 months of experience**. The denial concludes the employer’s stated requirements can’t represent the employer’s actual minimum requirements, so the application was denied.
**My lawyer’s argument for the appeal:**
My lawyer believes the employer’s requirement should be interpreted as **either** an Associate’s degree **or** 24 months of experience (not both). Because of that, the experience wasn’t submitted/provided the way the denial assumed, and we’re challenging the interpretation.
I have two questions:
- **How likely** is it that an appeal gets approved (or denied again) in situations like this where the issue is an education/experience mismatch or requirement interpretation?
- **How long** does a PERM appeal typically take?
If anyone has similar experience or advice on what to ask my lawyer, I’d really appreciate it. Thank you.
