**PRE-EMPTIVE LEGAL NOTICE (BODY CAM IS PUBLIC INFORMATION)**
Body-worn camera recordings created or maintained by a governmental body are **public information under** **Gov’t Code §552.002** and are governed by **Texas Code of Criminal Procedure Art. 2.139**. The City must **promptly produce** responsive public information (**§552.221**) and provide it in the requested medium when available (**§552.228**).

**PRE-EMPTIVE REBUTTALS TO COMMON WITHHOLDING CLAIMS**
**Gov’t Code §552.108 (Law-Enforcement Exception)**
§552.108 is **not automatic** and requires a **specific showing** of interference.

A disposition of **“Unfounded”** weighs against blanket withholding.

The City must release **reasonably segregable portions** with lawful redactions rather than withholding in full.

**“Sensitive / Internal / Officer Safety”**
Routine BWC footage is **not confidential in full**; targeted redactions suffice.
**“Special Form / State a Reason”**
The TPIA does **not** require a special form or a statement of motive (**§552.222**).

**APPROVED REDACTIONS (LIMITED AND LAWFUL)**
Because the call references bond/protective-order issues and personal identifiers, I agree to **narrow, lawful redactions** only, including:
**Driver’s license / motor vehicle identifiers** – **§552.130**

**Access device numbers** – **§552.136**

**Personal email addresses of members of the public** – **§552.137**

**Social Security numbers** – **§552.147**

**Juvenile information** (if applicable) – **Fam. Code §58.007 / §261.201**

**Medical / highly intimate information protected** by law – **§552.101**

**Home address / phone number** of private individuals (if present in the footage/audio) — redact narrowly and release the remainder

Redactions must be used to **release**, not to withhold, responsive footage.

**ATTORNEY GENERAL RULING REQUIREMENT**
If the City and/or Olson & Olson intends to withhold any portion of the requested BWC:
Timely request an Attorney General decision under **§552.301**;

Provide me a copy of the AG request and identify each exception claimed; and

Provide a sufficient description of withheld material to allow review.

Failure to comply triggers a **presumption of openness** under **§552.302**.

**FEES / PUBLIC INTEREST / MEDIA WAIVER**
This request is made **in the public interest**. I request a **waiver or reduction of fees** where permitted and electronic delivery to minimize costs. If fees are claimed, provide a **written, itemized estimate** before proceeding.

Please confirm receipt and provide the anticipated production date.
