Can an NIW and a later EB-1A be in completely different fields?
Has anyone seen or experienced a situation where someone first filed and received approval for an NIW in one professional field, then a few years later applied for EB-1A in a completely different field due to a career change?
My questions are:
- Can the priority date from the approved NIW still be retained for the later EB-1A petition?
- Would USCIS question the credibility of the earlier NIW or view the two petitions as inconsistent because the fields are very different?
- Are there any known successful cases involving this kind of major cross-field transition?
All of the experience and evidence in both petitions would be genuine. My main concern is whether the significant difference between the two fields could create problems in the later review.
