Repeated Defined CoS (DCoS) refusals & employer challenging the decision — Has anyone experienced this?

Hi everyone,

I’m looking for some advice, insight, or shared experiences from anyone who has dealt with Defined Certificate of Sponsorship (DCoS) refusals or legal challenges with UKVI.

Background & Timeline

  • Location: Currently in India (previously lived in the UK and left voluntarily). No active UK visa at present.
  • Sponsor: A UK employer with a valid sponsor licence wants to hire me. They issued a genuine job offer and are fully supporting my application.
  • The Issue: Over the past several months, they have submitted multiple DCoS applications. Every application has been refused by UKVI.
  • Legal Support: The employer worked with an immigration lawyer and used a specialized immigration platform for the latest submission, but it was still refused.
  • Current Status: Instead of reapplying immediately, the employer’s legal team has formally challenged / appealed the latest refusal and is currently waiting for a decision from UKVI. The company hasn’t withdrawn the offer, but they indicated that if this challenge fails, they will need to reassess next steps.

Questions for the Community

  1. Has anyone successfully had a DCoS refusal overturned or reconsidered after challenging it? What was the process/outcome?
  2. Why would a lawyer recommend challenging a DCoS refusal instead of simply submitting a new application? Does a challenge imply UKVI made a clear error (e.g., misapplying salary threshold / SOC code rules), or is it common after repeat rejections?
  3. Does a challenge yield results? In practice, does UKVI often reverse DCoS decisions upon review, or is it rare?
  4. Impact on future applications: If this challenge fails, will these DCoS refusals affect future Skilled Worker applications with another employer, or impact future UK visas (e.g., Student visa)?
  5. Has anyone faced multiple DCoS refusals and eventually resolved them? What ended up fixing the issue (e.g., changing SOC code, salary adjustment, Pre-Action Protocol)?

Any genuine experiences or advice from sponsors, immigration solicitors, or applicants who have been through something similar would be hugely appreciated.

Thank you!
