BTD700 and Dongle Control app

I'm using the BTD700 with a pair of Bowers & Wilkins Px7 S3 with my Windows 11 computer. In this specific scenario I'm not interested in aptX Adaptive HD - I only want to use aptX Adaptive LowLatency.

I have the following issues:

1. I have to switch to "Gaming Mode" (greenLED) e v e r y time. I've tried the app, I've tried the button. After every reboot it goes back to the pink LED (high latency). My understanding was that it should remember the last mode or that I can set "Gaming Mode" as standard with the app? Firmware is 3.11.0
2. I'm using the Dongle Control app version 1.0.5 and e v e r y time I start the app I need to accept the license agreement. It's no real issues, just strange (and maybe an indicator that something else is wrong).

AI seems to think there is an issue with the rights of the app (because of the reappearing license agreement) but I've also tried to run it as admin and it makes no difference for both issues.

Has anyone else these issues? Or is it a case of works-as-designed?

After reading several posts here it sounds like the BTD600 would've been the better choice for my use case - at least I got the impression that the BTD600 remembers the low latency as start up setting. Is that the case?
