In your regular dealings, you must have heard someone say that they are going to register a caveat on their land.

Many people do this to protect a claim or interest they have in a piece of property.

For example, a buyer who has paid money for land but has not yet received the title may place a caveat to stop the seller from selling it to someone else.

Family members in an inheritance dispute, spouses protecting matrimonial property, lenders awaiting loan repayment, and people who suspect fraud also use this tool to safeguard their interests.

A caveat is effective because once it is registered, the land registrar cannot approve any sale, transfer, mortgage, or lease on that property without the caveator's consent or a court order.

This means the caveat acts like a stop sign on the title, freezing any dealings until the matter is resolved.

However, it is not a tool to be used carelessly.

The law requires that a person have a genuine interest and reasonable cause before placing a caveat.

Anyone who registers one wrongfully or without good reason can be sued for damages.

Because a caveat carries such serious legal weight, it is worth taking the time to read the full article and understand how it works before you file, extend, or remove one.
