Who would be at fault in this situation? Texas
Trying to get an unbiased opinion on a minor accident. This happened in Texas.
There are two lanes approaching an intersection. One lane is for traffic waiting to proceed, and the adjacent lane is used for turning left at the upcoming intersection.
Car A was waiting in the lane next to the left-turn lane because traffic ahead was stopped. Car B came around Car A and began entering the left-turn lane because Car B needed to turn left at the upcoming intersection.
As Car B was entering the lane, Car A also moved into that same lane and the two vehicles collided. Neither driver says the other was already established in the lane.
Car A claims they were already in the left-turn lane and that
Car B came around them and entered a lane intended for opposing/incoming traffic.
Car B says they were entering the proper left-turn lane and that Car A moved into that lane while Car B was already in it. Car A had no blinker on, unfortunately.
The damage was to the front-right area of Car B and the front-left area of Car A.
There was also a witness for Car A, but the witness left before police arrived and did not give a statement
Who do you think is at fault, and why?
