Does anyone have experience with "constructive eviction"?
Recently moved into an non-smoking community in Oakland and I have a POS neighbor who smokes so much (they smoke for several hours almost every night), the smoke takes over my room and it's affecting my health. I've tried speaking many times with the building's management but they either don't know what to do or don't care enough to do something about it. They just send "strongly worded letters". As you can imagine, a heavy smoker who doesn't care about their neighbors is most likely wiping their butt with those letters.
I don't want to deal with this anymore so I want to get out. I've read about constructive eviction to break the lease but it seems like it's a lengthy and expensive process. Does anyone have any experience with the process? I think I have a good case. The smoke has been a problem from day one. I also happened to get in contact with the previous tenant and they told me they also were dealing with the same issue when they lived here.
