Filed a California Department of Insurance (CDI) complaint against an at-fault driver's insurance.

Auto Insurance

Hi everyone,

I was rear-ended a few months ago and have been trying to resolve the general damages portion of the claim with the at-fault driver's insurance company.

The adjuster has been incredibly difficult going radio silent for weeks at a time, failing to provide a backup contact while on vacation, and completely ignoring my written requests for clarification on how to submit documentation for my out-of-pocket expenses. When I pointed out California fair claims handling regulations and asked for direct guidance the adjuster ignored the statement and prior questions and gave me a flat ultimatum.

At this stage, my primary issue isn't even about the specific monetary amount it is about the complete lack of clarity, the unprofessionalism, and the exhausting, continuous follow-up I’ve been forced to do just to get basic answers regarding how they are evaluating my general damages, travel mileage, and copays.

I have maintained a meticulous paper trail of our email history showing my attempts to cooperate and their lack of response. I finally decided to bypass the adjuster and submitted a formal Request for Assistance to the California Department of Insurance, and I just received my official CDI Case Number.

For those of you who have filed a CDI complaint against a third-party auto insurance company:

How long did it take for the state to get a corporate response?
Did a supervisor from the insurance company eventually step in to resolve the claim?

Did the CDI process actually help break the stonewalling?
I am not looking for legal advice, just wanting to hear real-world experiences from other Californians who have used the CDI portal to handle an uncooperative insurance company. Thanks!
