Project breached BBA timeline

I have invested in a office space project in noida which had completion deadline of 31st december 2025 as per bba. The date has passed. The seller already has rera till 2028 since this is a 2 phased project. Now the date has passed and seller isn’t responding to my mails related to penalty. The project seems to be in progress and might get possession by jan-feb 2027. Do you think I should go behind the seller for penalty and can i really claim anything.
Experienced folks, please advice.
