Active-Duty Air Force Parent / Custody & Family Care Plan Question No longer with mother but left child with her brother in the same state as the Father, Father has no awareness
Looking for guidance from anyone familiar with Air Force Family Care Plans or military family law.
My ex-wife is an active-duty Air Force Captain. We divorced in North Carolina years ago. I am our daughter's biological/legal father and am listed on her birth certificate. To my knowledge, there has never been a custody order granting either parent sole custody.
My daughter had been living with her mother in Nevada. I recently learned that my daughter is now in North Carolina and attending school in the Charlotte area. I was not informed about the move or school enrollment, I do not know her current residential address, and my daughter told me that her location sharing on her iPad was intentionally turned off. she is also not living with her mother because she will be deploying
I'm trying to handle this correctly and through the proper channels.
My questions:
- Does an Air Force Family Care Plan require the other legal parent to be considered/notified before a child is placed with another caregiver?
- Is contacting her First Sergeant/Commander appropriate if I cannot determine where my daughter is living?
- Is there an Air Force office specifically responsible for Family Care Plan concerns involving another biological parent?
- For anyone familiar with interstate custody, should I address this first through NC family court, Nevada family court, or an attorney familiar with the UCCJEA?
I'm not looking to interfere with her military career. I simply want to establish where my daughter is, confirm she's safe, and understand my rights as her father.
Thanks for any guidance or firsthand experience.
