NRI landlord rent TDS: landlord's agent says start from August, what about April–July?
I’ve been renting a property in Bangalore since March 2023. The tenancy agreement was prepared and executed through a property management company, with their representative signing on behalf of the landlord.
At the start, I verbally asked the representative whether the landlord was an NRI and was told TDS wasn't applicable since the landlord in and out of India and USA. The agreements don't mention NRI status or TDS obligations, and the management company has refused to provide the landlord's direct contact details multiple times.
I recently raised the issue again since the latest agreement had a full USA based address. They have now confirmed in writing that:
The landlord has reported the rental income in his Indian ITR. There is no lower and nil TDS certificate. When they discussed the matter with the landlord and his CA, they didn't involve me in any of the calls. They instructed me to obtain a TAN and start TDS from this month, not April 2026. I repeatedly asked why April to July 2026 is excluded but haven't received the reasoning yet.
Questions I have:
-
If the landlord reported the rental income, what is my exposure for FY 23-24, 24-25, 25-26 and April–July 26?
-
Can I rely on the landlord's representative's written instruction to start from August?
-
Since the property management company prepared and executed the tenancy agreements while representing the landlord, does that create any legal responsibility on their part to disclose the landlord's NRI and TDS position in the agreement, or to provide a means for the tenants to contact the landlord directly?
-
What's the correct way to regularise this and protect myself?
I have the rental agreements, payment records and WhatsApp correspondence.
