QLD work cover gray area worried they will question fish to cancel my claim before asking key details
Title: WorkCover QLD Journey Claim: Crushed by rolling car on public street, but it started near my property line. Do I have a case?
TL;DR: Handbrake failed on my car as I was leaving for work. In a split-second panic to stop a public disaster, I chased it. I was crushed between two cars and my arm was broken completely out on the public street. WorkCover is calling soon. Early ambo/GP notes vaguely say "at home" due to my shock/pain meds. How do I protect my claim?
The Details:
The Incident: I finished my morning routine and was right at my property line about to get into my car to commute to work. The handbrake suddenly failed and the car began rolling toward the street. To prevent a catastrophic public safety accident, I reacted on impulse to stop it. As I tried to jump in the car my shirt was caught on the door dragging me back outside of the car.
The Injury: The vehicle rolled out onto the road, and the actual crushing and my broken arm happened 100% out on the asphalt of the public street. Between my car and another.
The Complication: Because I was in extreme physical shock and heavily medicated (green whistle/morphine) at the scene, the early ambulance, hospital, and GP notes just use quick shorthand like "accident at home" or "in driveway."
The Legal Side: I am on a No Win, No Fee arrangement with a QLD personal injury lawyer who thinks I have a good chance under Section 35 of the Workers' Compensation and Rehabilitation Act 2003(Journey Claims). However, I want to keep my final legal bills low and maximize my potential payout to afford to live.
My Plan for the WorkCover Statement Call:
If WorkCover calls me directly before my lawyer takes over the call, I plan to stay completely honest but highly disciplined. When they fish for property line details, I am going to state:
My morning routine was finished and I was executing my commute.
The split-second panic of the vehicle first moving is blurry in my memory due to shock, but I know for a fact my feet were out on the public road when my arm was crushed.
The early medical notes are just inaccurate emergency shorthand written while I was heavily medicated.
Questions
Has anyone successfully fought a WorkCover QLD journey claim where the incident started at the boundary but the injury occurred on the road?
Should I strictly refuse the phone interview and force WorkCover to go through my lawyer, even if it adds to my final legal bill hours?
