Community College Library and tresspassing citation (banned for 1 year)
LOCATION: TEXAS
Our local community college has libraries that are open to students, faculty and public. Of course priorty access to the student/staff but public is able to use it.
I'm professional who goes to the library to work/study. The hours are better and its more academic than the public library which has kids/teen programming etc.
They don't require an ID, or sign in but librarian told me that you are welcome to come and study here.
I received an UNEXPECTED trespass warning and one-year exclusion from HCC property following an incident at the HCC library.
This was my first or second day returning to study at this library in approximately a year. After arriving, I set up my study materials and realized that I had accidentally left my laptop charger at home.I had also been trying to refill my water bottle and checked multiple floors without finding an available water source in the entire building due to renovations. Given the summer heat and the importance of staying hydrated, I ultimately went outside to refill my water. Because I live relatively nearby, I decided to return home for my charger and then come back to continue studying. The trip took longer than I anticipated because of traffic and traffic signals.
As I was leaving, the campus security / police officer called out to me from his station about leaving valuables behind and told me that he would not be responsible for them. I acknowledged that I understood. I understood his statement to mean that if I chose to leave belongings behind, I assumed the risk that they could be lost or stolen. Based on that understanding, I specifically took my valuables with me.
The items I left at my study space were ordinary study materials and supplies, including books, papers, a pencil case, a laptop stand, a wire, and similar items. I understood that I was assuming responsibility for those belongings by leaving them there.
When I returned, I was surprised to learn that I was being issued a criminal-trespass warning and would not be permitted to use HCC property or its library facilities for one year.
I was told that I had previously been instructed regarding this issue. I do not want to dispute or dismiss the officer's recollection, but I genuinely did not understand that I had been instructed not to leave any belongings behind. I also did not understand that doing so could result in a trespass warning or exclusion from HCC property.
Had I understood the instruction as, "You may not leave your belongings here when you leave the property, and doing so could result in loss of access to HCC facilities," I would have taken everything with me.
I know the officers have a LOT OF LEEWAY in when they can issue a tresspassing warning banning me from returning for a year but seems crazy and excessive.
Additionally I remember last year (so more than year ago), building was open till 10pm so I would leave around 9:45/9:50pm. That would annoy them ?
