Abroad Education Scam carried out by a consultancy

So me and my dad consulted a agency for education abroad, now I didnt get the Public UNI as they advised me 2 are still pending like I got rejected in 4. Now I would like to know whether I could file a case against them and the thing is there was terms and conditions.

It stated that refund policy only works if I get rejected in both public and private UNI. Now they gave us assurance with the word of mouth I havent recorded it. But what will be the likelihood of the case and will i get my money back because I dont think I will get selected.

And this was a premium package, spent 1.6lpa and they made sure I got offers from Private UNI even though it is expensive compared to Public UNI. I just wanted public UNI but I dont think I would get into any.
