I was fired while taking parental leave — wife is 8 months pregnant
I was fired last week as part of what my employer described as a global organisational restructuring. I’ve been with the company for just under five years.
My employer knew that my partner and I are expecting our second child in about a month. I was planning to take around 20 days of paternity leave following the birth, in addition to roughly 20 days of regular holiday that I had saved up.
I had also told them that I would probably take around a month of parental leave in March 2027 to bridge my wife's leave and daycare start.
On top of that, for the past two years I have been working at 90%, taking every second Monday off as parental leave related to my first child. This arrangement was already approved and is due to end in September.
Then, last week, I was dismissed.
They are paying me the legally required severance/notice amount, and they are currently looking into whether they will reimburse me for the 20 days of paternity leave I would have taken after the birth.
Given the timing just before the birth of my second child, not to mention my five-year work anniversary and the fact that I should technically have some protection against being dismissed. Is this something I should pursue further or would it be better to just let it go?
It also seems the restructuring targeted the closing of a facility in another country rather than mine and I seem to be the only Belgian impacted in my team or even department.
tl;dr: I was fired, while on a period of parental leave, am I protected?
