Collections sent me a Small Claims Court Letter - is this real or a scare tactic?
I got a small claims letter via Registered mail. The It is form 7A Ont. Reg. No: 258/98
the court File No is SC-25-00{xxxxxx}-0000 (I redacted the middle numbers).
in the Letter It seems to be for the Small Claims Court at 161 Elgin Street, 2nd Floor Ottawa, ON K2P 2K1 (613-239-1079)
The Plaintiff on the form is the company I originally had the debt with, but when I last checked my credit report it says the debit was written off.
The Representative is a paralegal for a collections company and the Law Society Of Ontario no seems legit when I do a search for their LSO Number.
When I search the Case Number I can't seem to find it when I go here: https://courts.ontario.ca/portal/search/case
I tried a Case Search and a Single Party Search but no hits.
Just wondering if there is another site I need to go online to search or if there is some other way to verify if this is a an actual processed court file that I need to respond within 20 day or if it is just a scare tactic to pay. All the info they presented seems correct. FYI I am not in a position to pay it now and was looking to settle this when I have money but now is not a good time but if this is real, I need to respond within the 20 day window or else I will get a default judgement against me.
My goal is to see if I can settle this once I have a bulk amount as I have heard of some collections accept a portion of the amount if I pay a big lump sum but it would be significantly smaller than the original amount.
