Taobao lizlisa proxy help

This is my first time ordering lizlisa through a taobao proxy, I have no experience and don’t know what to do at all. I bought a lizlisa setup in early February of this year and the seller said they will ship before CNY but after a few days later the seller said there is no stock left at the lizlisa store and it has been 7 months since then.

I checked on rednote as well and there seems to be some sort of etiquette when buying through proxies that I’m trying to follow. These Japan proxy sellers on taobao usually will have a TOS and on it is a no return/refund policy but since lizlisa doesn’t have any stock left so the seller is unable to purchase it on my behalf. Would I be to apply for a refund without offending the seller?
