[WV] Received a cease & desist based on fabricated textd

Employment Law

Location: West Virginia

I received a cease and desist from a former employer. It was a small business, person in question is the owner, employee being referenced is the GM. I worked for them temporarily for about 7 months.

The letter itself is in regards to me "violating" the non solicitation agreement. She included screenshots of texts that I allegedly sent to her current GM claiming that shes "happy where shes at" and then i allegedly responded to that with an offer of $22/hr and details about a job thats opening at my new job, which is more than shes currently making.

My assumption is that the the GM didnt realize I had such a clause in my contract and tried to use my "texts" with higher pay to negotiate her own pay raise which has clearly backfired.

The thing is, the ORIGINAL conversation, the unedited version of that conversation was her reaching out to ME asking for details on a position that she knew would be open at the place im going to be managing soon. In response to that, I sent the indeed post and the details. She then took my texts and somehow changed her own texts completely, and adjusted mine to be for a higher pay then actually mentioned. The conversation in the edit version reads as though i was trying to convince her to leave her current job and join me at mine for XYZ reasons.

Now I have this cease & desist and honestly...im kind of petty and this feels like a hill i do perhaps wish to die on.

Also worth noting that she had the audacity to send me this cease and desist BEFORE sending my final paycheck. Its been 22 days and in our state the limit is 72 hours. Amongst other things, she was illegally and secretly audio monitoring all of us in the office, so who's to really say she didnt fire me for retaliatory reasons?

Would love to know from the experts how i can proceed. My goal really would be to at the very least, knock her off her high horse.
