Is this a case for medical malpractice? Is there anything I should be looking for or adding?

Healthcare Law including HIPAA

Location: Nashville, Tennessee
So I went to an inpatient facility here in Tennessee because my chronic pain had gotten so bad it made me suicidal and self injurious. I am being tested for gastric issues right now which the pain can get to 10/10 which I don’t say lightly. After a month of ER visits and even getting so sick I couldn’t ingest water, my doctor and I found a combo of meds that help make things tolerable as I find out what’s happening. After that stability physically, I voluntarily went inpatient at a facility I didn’t know as well because my hospital with my providers didn’t have beds. I mainly needed back on one of my meds that I had to stop during my physical episodes so I could take the more extreme pain meds like dialudid

During this stay, they fucked up my meds big time and the meds used to stabilize my pain and nausea which were both PRN maxing out at 4 times a day (compazine and a muscle relaxer called robaxin on a scale from 500mg to 1500mg prescribed by my actual doctors) were only given every 8 hours and also at the wrong lowest dose only and the compazine was replaced with a very low dose of zofran which did nothing for me because they didn’t ever get it for me. They also refused multiple of my other meds too and failed to report that.

One night, despite not eating which is usually a trigger for pain, I randomly went from 0 to 100 in pain and had to drag my wheelchair up to the nursing station where I was ignored and told to go lay down without my meds. I was already sweating through my shirt, crying, and gagging and no one would help me with even one nurse saying “not my patient not my problem”.I begged for any help at all and so did other patients who were disturbed by them leaving me writhing in pain and eventually went into the patient bathroom by the nursing station to throw up from the pain.

I stayed in there throwing up water then dry heaving mucus when I had nothing left. They randomly did Q15s where at most they would open the door and ask if I was good and ready for bed and when I’d say no please help they’d leave. Eventually my nurse said I had to get up off the floor and go to bed and forced me in the hallway while I was still dry heaving with no meds. Another nurse yelled at me for dry heaving in the hall so I went back in the bathroom and got on the floor by the toilet.

I started passing out so when my nurse finally came around 20 minutes later I told her that and she offered an anti psychotic. I said sure if it would help which I knew it wouldn’t it wasn’t one that does anything for pain or nausea. She said she’d be back in a minute and wasn’t and I was getting worse. I pushed the emergency button and according to the other patients the light went on above the bathroom and the bell went off but the nurses turned it off and kept yapping. They did that twice. That second time, as I was forcing myself up to stand for the emergency button, I fell and seized hitting my head. Again no one checking on me. Woke up and couldn’t move bc I went into a tonic seizure and my post ictal was bad. Still no one. Fell into another seizure. Still no one. Woke up to a tech telling me to get up and go to bed already and acting like I was an inconvenience. I fell into another seizure and the last thing I heard was her calling code blue.

I woke up to someone sternum rubbing me so hard it legit broke my sternum according to X-rays and on my back meaning I hit my head even more on the concrete floor bc they didn’t protect it and instead were pushing ammonia salts in my face over and over despite choking on my tongue and being unable to respond. I kept going in and out of consciousness and they kept having to fight for me to stay awake and my vitals sucked yet they got me into my chair eventually and just pushed me into bed. No medical care, just put in bed.

The next day I AMA’d and this doctor who wrote this note had a maybe 2 minute conversation about what happened in which I informed her for the millionth time she was reading the med wrong. She then admitted to it and said she thought the dose I was given was too high and it’s make me pass out so I pointed out that not giving it to me made me sick, pass out, and seize and she walked off. Here’s the wonderful note in my record left by that doctor:

This is a 26-year-old female to male who presents to the hospital with conversion
symptoms. Patient has chosen name is—-. The records indicate suicidal
ideation prior to admission. Was also endorsing auditory hallucinations. Patient
states that they can not eat food. Describes pain when eating food. Last night, the
patient states that they were having epigastric pain and requested to take Robaxin
*at 1500 mg. (****Note from OP: I told her it was a scale from 500-1500mg at my discretion up to 4 times a day which is in my medical notes by my doctor)***This was refused in which the Robaxin was set at 500 mg q.i.d. PRN.
The patient then began to have “increase symptoms due to pain”. The patient
states that they had a seizure and felt that the staff was ignoring their symptoms.
We spoke at length about this. the patient tends to rationalize. The patient states
that the Robaxin has been given at 1500 mg at his discretion by his physician. This
is described as “my outpatient doctor lets me take this this way so I do not have to
use narcotics”. The patient is in a wheelchair. Explained Muscle relaxers at high
doses can cause discoordination and sedation. However, the patient has no insight
and believes that the high dose will help contain pain. I reviewed the records and
spoke with the patient. There appears to be no etiology of the patient's abdominal
pain and muscle weakness. However the patient does not believe that they have
conversion disorder. On evaluation, the patient has multiple cuts noted on arms.
Therefore the patient has self-injurious behavior. Patient states that they have filed
a grievance in which they feels her medical needs are not being met. This is
described as “negligence”. The patient also signed an AMA letter.
On evaluation, the patient appears to be low risk. The patient denies suicidal
thoughts. The patient denies being depressed. The patient is showing no suicidal
behavior. The patient does have self-injurious behavior. However they displayed
this secondary to poor coping skills in which they feel their needs are not being met
and having seizure-like behavior and episodes of weakness which they describe as
falls. They appeared to be upset at staff in which they feel they should be able to
have 1500 mg of Robaxin at their discretion and immediate attention from nursing
staff.
The patient appears to have capacity to make medical decision. The patient is
alert and oriented x3. The patient's memory is intact. The patient knows why there
in the hospital. However the patient's insight is limited in which they firmly
believes that the condition is medical in nature. The patient is able to
communicate.
This patient is low risk and can not be committed. Therefore, the patient to be
discharged AMA.

I got out that day and went to a clinic that diagnosed a mild TBI and sternum fracture the next day. There’s still so much more to it that makes it worse but I can’t even get into that shit right now.

Also for context, I have years of providers never diagnosing me with any form of psychosomatic symptoms or BPD. I also have never reported or been treated for psychosis??Those are also two real issues that shouldn’t be weaponized against patients. I have YEARS and THOUSANDS of pages proving my very real disabilities yet she deemed me insane in 5 seconds yet released me AMA? Huh…just seems interesting.

Is this a case that would be seen as doable? How bad would the mental health portion of this be as far as damaging my case? Any advice is welcome!
