Small claims for damages leading to undue hardship
Location: Tulsa County, Oklahoma
I split from my ex common law husband almost 2 years ago and haven't needed to change leases until recently (homeowner is selling). When I started applying for places I found out that my ex racked up $3.2k in damages at the last place we had together. Some of it was the cats we had(I'm willing to pay that) but 2k of it is from him turning the utilities off (not in my name) and going to live with his parents. I have family and friends giving me loans to pay for the damages but they live out of state and in the meantime I've been living out of a hotel with my 7 month old for almost a month now. All my deposit money is gone and spent on keeping a roof over our heads. Between the damages and hotel stays, this will cost me at least $6k. And that's if I'm able to move within the week.
I plan to take him to small claims for his legal half of the damages, but can I use my hotel receipts, bank statements ,and phone log to prove he caused undue hardship on my family after reaching out for 2 months about him paying his half to get my money back on hotel stays? I do believe this is worth pursuing since he, on average, makes $6k/month. Is that reasonable enough for a judge? Or should I just stick with the damages? I only make $3k/month but it's hard to prove because I'm a server.
More info: damages from the utilities included $1000 for replacing the refrigerator and many other smaller charges for not having the utilities on and late fees over the span of 5 months. I left before he did so I just assumed he stayed there, if I had known he was going to leave I would've just kept the place.
