Location: Los Angeles. Eviction-Ghosted by attorney after landlord violated our eviction stipulation
In June, my landlord and I signed a stipulation giving me until August 15th to move out without paying rent, promising a full dismissal and a sealed record once I vacated. They requested 500$ which I paid, but to this day I don't know what that money was for. The agreement said a lockout could not happen before August 16th.
I complied fully, moved out early on August 1st, and returned the keys directly to the landlord with written proof.
However, the landlord's attorney filed for a writ of possession two weeks after our stipulation/settlement weeks before my deadline while I was in full compliance. The court clerk confirms a judgment of writ of possession was entered after the stipulation record and that it's active. The landlord's lawyer lied over the phone saying it's a normal procedure that happens to 90 percent of tenants and not important.
Because of this early judgment and writ of possession, I don't know what happens to my record sealing.
The lockout was supposed to be after August 16th, but I just received a Sheriff notice in the mail in September at my new address showing they were supposed to execute the writ 10 days before I even got the letter. The notice said they were executing it in 5 days, but the dates are completely messed up. To make it worse, they charged me rent for dates after my move-out day, threatening collections if i dont pay.
My own attorney is completely ghosting and not returning calls.
I want to know exactly what to ask my attorney so he knows I know my rights. If I must contact the landlord's attorney directly, what should I demand they do to fix this regarding the false rent bills, the early judgment, and the writ of possession?
