I-485 approved when priority date is not current
I am writing to seek guidance regarding an issue with my USCIS I-485 application.
On October, 2025, I filed my I-485 application along with the I-485 applications for my husband and our children. Our priority date is March, 2023(India), under my husband’s approved EB1-A I-140 petition.
Our priority date was current under the Final Action Date (FAD) in April and May 2026. My husband’s I-485 application was approved on April 9, 2026, while my application and our children’s applications remained pending.
On May 8, 2026, I received a Request for Evidence (RFE) requesting additional evidence of our marriage. I submitted my RFE response on May 15, 2026. However, the priority date retrogressed beginning in June 2026 and has remained non-current in subsequent Visa Bulletins.
Despite the retrogression, USCIS approved my I-485 application on September 9, 2026, while our priority date was still not current.
I am concerned about whether this approval could cause any issues in the future, such as USCIS revoking my Green Card because my I-485 was approved when the applicable FAD was not current.
Could you anyone please advise. I have already raised a request through the congressman.
Note: We didn't do any porting.
