Confrontation involving several members of one family while I was parked on a public road waiting for my child – what should I expect from police?
England.
I’m deliberately keeping locations, ages and identifying details vague because this has been reported to police and there is video evidence.
I was parked in my van on a public cul-de-sac/service road near a school, waiting to collect my son.
I was parked partly on the kerb to leave as much room as possible for vehicles to pass, while still leaving sufficient room for pedestrians. There was also an empty disabled bay opposite.
A woman from a nearby property approached and asked whether I was just having my lunch and whether I would be leaving afterwards.
I explained that I was waiting for my child and would be leaving shortly. I also immediately suggested a practical solution: she could move her vehicle into the empty disabled bay and I would move my van further forward, so there would be no issue with vehicles passing.
Instead, the situation escalated very quickly.
Several members of the same household became involved. An older male subsequently came out carrying a long pole/object, approached my vehicle aggressively and shouted at me to leave.
There was then an attempt to access my van, banging/striking against the vehicle, threatening and abusive language, and physical contact with me and my phone inside the van. Other members of the household also became involved rather than calming the situation down.
I eventually called police while still inside the vehicle when the male member of family that held the pole said 'I'm gonna grab you're boy'.
My son arrived during/around the incident and was exposed to at least part of what was happening.
The incident has been reported to police. I have since discovered that my dashcam recorded effectively the whole encounter, including the initial conversation and escalation. I also have separate mobile-phone footage/audio from later in the incident, and there appear to have been independent witnesses nearby. Also, I have pictures of potential damage to my vehicle made by banging and palm/fingerprints from the guy when he was trying to force window down.
I’m mainly trying to understand what happens next from the point of view of a victim/witness rather than speculate about what police will ultimately charge anyone with.
A few questions:
What should my son and I normally expect from police now? Would they usually take formal witness statements from both of us, review the footage first, interview the other parties, etc.?
What possible offences could this sort of behaviour amount to? I’m thinking in terms of threatening behaviour/public order, assault or battery, attempted entry into the vehicle, damage to the vehicle, etc., but I don’t know where the thresholds sit.
Have I potentially committed any offence simply by parking partly on the kerb on a public road? This was outside London, there were no signs prohibiting parking there, I was not blocking the road, and pedestrians could still pass. I appreciate obstruction/pavement parking rules may be separate issues.
One of the residents repeatedly claimed the road was “private”, although I have since checked the highway authority’s records and it is recorded as maintainable at public expense. Does that make any difference to the underlying incident anyway?
Would it be sensible to contact the legal-expenses helpline attached to my motor or home insurance now, or is that unnecessary unless police proceedings/civil issues develop?
Is there anything in particular I should be doing with the evidence now apart from preserving the original dashcam/mobile files and writing down my recollection while it is still fresh?
I’m not looking to identify anyone or start a witch-hunt. I just want to understand the process and make sure I preserve the evidence properly.
Also I would like to make note that the incident left me in quite distressed mood, elevated blood pressure for hours after and constant overthinking/analysing loop. Does that contribute to any damages suffered?
Thanks.
