AOS, now removal proceedings.
Hello. I don’t even know where to start this, I entered through the border on Oct,25, 2021 with my family, I got processed individually because I was already 19 years old, I was served a NTA while in detention, and then released me on recognizance, plus paroled through 212d5, my NTA was never filed with the EOIR, and one of the charges saying that I was never admitted or paroled when I entered through Del Río, TX, is wrong (they served me the NTA first then when releasing me, grant me a parole). I’ve been under my family asylum all these years which has been pending, and eventually got married to an US citizen, and filed 130+485+765. My parents had their first hearing on July 29th, 2026, where I was present too even though my A number was never in removal proceedings, and that’s where they realized that, we explained that my NTA was filed, not even the date and time for a hearing which remained as “to be set”, and after the hearing, a couple weeks later, I received a call in letter for ICE with date Sep 16. Since I filed my AOS on Sep 11, me and my lawyer didn’t have the receipts yet, but the Fedex delivery notice says USCIS received the package and was signed by an officer. We presented all the legal evidence we had, including my parole which even though it was expired, marks me and qualifies me for USCIS requirements of being “admitted and paroled”, they still didn’t care, I guess they caught me out of status, and ended up detaining me there. I spent 24 hours detained at the Miramar processing facility, and then was released with no bond and just an ankle monitor. They gave me court hearing for Oct 16. Do I still have hope? Could I present evidence my 130+485 were filed before removal proceedings started? Also present my old release documents+parole, and try to either get court proceedings terminated or get a continuance while I get my 130 approved then get a termination? I do have a lawyer but with everything that has happened these days, and all the money I’ve spent in these processes, I feel a bit down, and my head is full of questions and different outcomes.
