UK – Disability discrimination grievance partly upheld, core complaints rejected. How strong is my case?
**•** I've worked in sales for several years and have long-term health conditions that Occupational Health (OH) says are likely to count as a disability.
**•** My employer has known about my conditions for over two years. They never made adjustments and only referred me to OH after I raised a grievance.
**•** My pay rose after a good performance review. My performance then dipped during a period of serious ill health and difficult personal circumstances, which my employer knew about.
**•** A new manager put me straight onto a formal performance improvement plan (PIP) with rising monthly targets. There was no informal discussion first and no consideration of my health.
**•** The whole team is well below target. Colleagues performing worse than me weren't put on a formal PIP, as far as I know.
**•** I raised disability discrimination in writing. Afterwards:
**•** accounts and revenue I'd already booked were taken away or excluded from my PIP figures
**•** a senior manager suggested I think about whether the job was right for me
**•** I was told that, as things stood, I'd be dismissed
**•** I was also put on a PIP after a serious health event a few years ago. (Late term miscarriage)
**•** The grievance outcome partly upheld my complaints about adjustments, OH delays, lack of support and lack of transparency, but found no discrimination, harassment or victimisation.
**•** OH recommends reducing my targets and making other adjustments. None has been put in place yet.
**•** I've appealed. The PIP is paused but not withdrawn, and I'm off sick because my health has got worse.
There are obviously lots of other factors that play into this and loads of evidence of everything. The grievance investigator tested each point individually against direct discrimination, but failed to do any tests for indirect, victimisation or failure to make reasonable adjustments.
My questions are:
How strong is my case if I have evidence to prove nearly everything?
If work are to offer me a settlement, what region would I be looking at? My salary is £100k, been in the role 5 years.
Ideally I want them to admit wrong doing and put reasonable adjustments in place but I think they’ll go settlement route.
Thanks so much
