โš–๏ธ Trump administration asks Supreme Court to revive rapid deportations: Appeals court requires migrants get chance to raise safety concerns ๐Ÿ‘‡

The Trump administration asked the U.S. Supreme Court on Thursday to allow rapid deportations to third countries to continue while a legal battle over the government's immigration policy moves forward.

Solicitor General D. John Sauer filed an emergency application on September 24 asking the justices to stay a ruling from the 1st U.S. Circuit Court of Appeals. The Boston-based appeals court upheld requirements that people facing removal to a country other than their own receive notice of their destination and a meaningful opportunity to raise concerns that they could face persecution or torture there. The lower-court order does not prohibit third-country deportations outright.

The dispute is Department of Homeland Security v. D.V.D. and stems from a class-action lawsuit filed in federal court in Massachusetts. The administration argues that the additional procedures could significantly delay removals and interfere with agreements negotiated with foreign governments. The plaintiffs argue that people cannot meaningfully exercise protections against persecution or torture if they are sent to another country without sufficient notice and an opportunity to object.

The practical impact was immediate. After the appeals court clarified late Wednesday that its ruling was in effect, the government halted planned third-country removals. Court filings indicated an upcoming flight from Alexandria, Louisiana, was expected to make removal stops in Rwanda, Burundi and the Central African Republic.

The policy has become a significant part of the administration's immigration enforcement strategy. Department of Homeland Security General Counsel James Percival said this week that approximately 25,000 people have been deported to third countries. The administration says third-country removals are needed when people's home countries will not accept them or when they cannot legally be returned there.

The Supreme Court docket shows the emergency application was submitted to Justice Ketanji Brown Jackson, who handles emergency matters arising from the 1st Circuit. She ordered the challengers to respond by 4 p.m. September 28. The court has not yet ruled on the administration's request.

What process should be required before someone can be deported to a country other than their own?
