CA: I was sent home from nail technician job for contact dermatitis. It’s been one week and I haven’t received paperwork or seen doctor.
Hi guys. I was sent home from work on Friday due to the skin on my hand peeling away in large chunks, aka contact dermatitis. That night my boss texted me saying she’s going to start a workman’s comp claim, and that I’d have to see a doctor to complete the claim. It’s now been 7 days since being sent home, and my hand has almost completely healed itself. I also have not yet seen a doctor or received any documentation or paperwork regarding my workman’s comp. When I check the state of California department of industrial regulations FAQ website I see multiple things that should be happening or didn’t/haven’t. Examples of these include: (I’m copying & pasting)
- Post the workers' compensation poster in a place where all employees can see it.
- Provide a workers' compensation claim form to you within one working day a work-related injury or illness is reported
- Return a completed copy of the claim form to you within one working day of receipt
- Forward the claim form, along with the employer's report of occupational injury or illness, to the claims administrator within one working day of receipt
- Within one day of receiving your claim, authorize up to $10,000 in appropriate medical treatment
My boss is asking me when I’m ready to come back to work, and I’m not sure how to answer. Although my hand is basically better, I don’t want to compromise my case by returning to work before being seen by a doctor. What should I do?
