Sole custody and passport CA

I recently applied for my daughter's passport who is 8 years old. I have full legal and physical custody of my daughter no visitation with bio dad. My custody order is connected to a DV order which has expired but my custody has not, as stated in my DV140 section 14 which states that my custody does not expire if attached to a DV130 which is how mine is. I received a letter from U.S dept of state national passport that states my application is on hold because my order is expired, but they failed to see section 14 in the DV140. Has anyone else dealt with this and what did you have to do? ​

Im so lost, I'm going to try and call tomorrow and see what they say.
