OC is mad at me that they didn't replace an attorney who left
Background: I have a litigation case where the opposing attorney didn't seem very engaged, wasn't responding to emails, etc. Not a big deal, but it was a little frustrating. Then we get a notification from the court that expressly directed us to confer and then respond. I reached out to OC and received a reply from another attorney, stating that the first attorney had left. New attorney first said he'd be the new OC on the case, but then almost immediately said that he wouldn't be, because they were hiring someone else who would take this one. He said that the new, new attorney would be on board within a week.
Now: About 6 weeks have passed, with no communication from anyone on that side. We served written discovery about 2 weeks ago, and haven't heard anything. I did notice that the court still showed the original OC as attorney of record, with no one else at her former firm on the service list. Most urgently, no one ever responded to my effort to confer, as the court had directed. Our deadline is Oct 1.
So I called the new attorney, who is the only person who I've communicated with since the original OC left. I tell him that I know he isn't the one taking the case, but I need to talk to someone. I mentioned both the court's order and the written discovery that we served.
New attorney gets defensive, starts raising his voice, and acting like I did something wrong. He's complaining that I served written discovery without telling him, even though he's not attorney of record and expressly said he wasn't going to be involved in the case. He also admitted that they still didn't have an attorney who would be taking this case... though it might happen soon? Basically, he was mad at me for his office failing to bring on a new attorney to replace one who left about 2 months ago.
Here I was thinking that I was helping them out, but this attitude really got to me. The OC who left and her firm are the ones who f'ed up. I could have just sat back and done nothing, gotten the admissions due to failure to respond, and otherwise really pounded them for their incompetence. It seems to me that everyone on that side has violated their obligations to the court and their client.
Anyway, I'm just ranting, I guess. How was your Monday, everyone?
