Traffic ticket for speeding away from danger?
Hello reddit! I would really appreciate some feedback on this. I was commuting to work this morning and received a ticket for speeding away from a large truck that was entering my lane. This happened right after we (truck and myself) exited the freeway. The speed limit was 40mph, I moved to the far left lane and proceeded to pass the truck at roughly the 40mph speed limit. As I was directly parallel to the truck he began moving into my lane, and given that the road was completely open ahead of me (and I thought he could not see me), I accelerated to avoid being hit. The officer acknowledged that the truck was entering my lane, but stated that the safer action would have been to slow down and let him make the lane change. My argument to this is that in the moment I am only thinking of avoiding being sandwiched between the median and this large truck. My initial reaction was to accelerate away from danger, rather than stop and check if there is a vehicle behind me and then slam on my brakes to let the truck enter the lane.
Do I have any grounds on which to fight this?
