Apartment debt sent to collections without my knowledge
First off this took place in Virginia. My wife and I vacated our apartment complex on February 23rd of 2015. When we entered the complex in 2013 there was a no deposit deal going on along with a first month rent free deal, so upon vacating the apartment we did not give a second thought to the fact that we did not receive any correspondence in regards to a deposit or anything but we did leave them with our forwarding address and other information in the event they needed to contact us.
Fast forward to today, my wife received a text from her estranged mother that she had found two summons for a court date on her door. I called our old apartment complex and they said they sent it to a local collections agency in March, less than a month after we vacated our apartment. So here are my questions:
- Is this legal?
- Doesnt a summons have to be delivered in person? Not to the wrong person at the wrong address? Or is that just on tv haha
- Should I go to court? Can it be handled outside of court? I tried contacting the collections agency but they are closed.
- What the fuck should I do here??
Thanks for the assistance!
