Noisy new neighbor in APT, Texas

Recently we have received a new upstairs neighbor with 2 toddlers. I will prefix this with we have had noisy neighbors before but nothing like this. These kids do not stop. They constantly are running and falling on the ground, I can hear their screeching yells and crying. We have asked the upstairs neighbor to try and keep the noise down, she said there is nothing she can do about it. We sent leasing office video of the noise, even had them come up and they told us that the noise was perfectly acceptable but might be inconvenient and is not a violation of the noisy tenant's contract. I can say that working from and living here that the noise being inconvenient is a gross understatement. They have stated that we can break our lease for an amount of about $4000 or pay for a new apt in the build and sign a new lease. I cant help but feel like we are getting ripped off. Is there anything I can do? I also hate that this has turned me into 'that guy'.
