I got hit by a car while on my bike. What should I do now? [Austin, TX]
Almost a week ago in Austin, TX while on my way home from work on my bike, a woman took a left turn across the lane I was in (coming from my right) and hit me throwing me over her car and onto the road. I was taken via ambulance to the hospital where they ran tests, x-rays, ultrasounds and was treated for injuries to my face and head. I contacted the insurance company of the woman who hit me to make a claim. When they called me back today they let me know they would only pay 50% of my bills because they have determined that we are "equally responsible" for the accident so we should each pay 50%. They also said that I "probably drove into oncoming traffic". I do not agree with, or do I believe, anything they are telling me and I would like to determine what legal options I have. Would this be the time for me to seek legal council? Should I try to go through my insurance company first? Are these scare tactics to try and pay as little of a settlement as they can? If more details are needed, I can provide them. Thank you.
