After a long wait, the Supreme Court announced today that the Federal Government had waived its right to response in the appeal of u/CaptainClutchMuch’s case. The Former Governor’s attorney, u/BatlhazarFuhrer, himself being tried on several charges, had filed a motion appealing the conviction of a single charge.
The petitioner argued that the appointment of the Special Prosecutor by President u/WaywardWit was unconstitutional due to the President usurping the right of the Senate to advise and consent to the appointment of an Attorney General. Furthermore, petitioner argued that the conviction of the defendant was invalid due to the jury being misled and sought to overturn the guilty verdict on not only procedural, but legal grounds as well.
The Former Governor was convicted of exceeding his authority when executing a warrant and was convicted to a year imprisonment.
Special Prosecutor Drops Ball
The Special Prosecutor for the State, u/DocNedKelly, was invited to submit his brief to the court on December 31, 2016. According to the rules of the court, either a response or a request for a stay must be submitted within four days of the filing of the petition. Apparently the government is so sure of its case that it has failed to submit any response whatsoever to both the petition as well as the various Justices' questions^1 Additionally the federal government has not shown any interest in following up on the three charges which were undecided by the initial jury.
