What are the downsides of going forward with Perez?

He has always been my pick, but most of my Dems supported Tolliver, who is not just crazy but is now filing a lawsuit.

It actually wouldn't surprise me if he leaves the party soon, but we generally thought his loss would benefit Perez either way.

I don't know any major problems with Perez - and honestly I see no negatives from him taking the seat.
