Rental - tree close to balcony

I asked the rental agent if they could trim the tree because it looks like its only a few weeks away before it breaches the balcony. They said their gardener already inspected and determined it was safe. Sounded like a fabricated BS response at the time.

How close is close enough to cut them back? I'm worried they'll come down in strong winds and cause damage.
