Buyer Help needed (new)

I recently (last week) bought a jersey through an eBay seller, he hasn't shipped yet, I asked him a couple days ago when I should expect to see it as "Shipped" and he still hasn't gotten back to me. so I'm wondering what my options are, as he has his "Cancel Order" set to only available 1 hour after purchase. if I can take action through eBay that would be great, but it looks like I need to wait a month to do that ? Any help would be greatly appreciated.
