[OK] Injured at a business

I was a guest at a business through no fault of my own I was injured by one of the employees in an accident. I am going to have to have surgery to repair the damage, and will also miss some work. I was told they have insurance, but they haven't been super helpful yet. I also do have health insurance.

So first, do I need a personal injury attorney?

Second, is it ok to use my health insurance and then point them back to the business when they inevitably see the accident ICD codes?

And third, should I get the surgery scheduled while they haven't contacted me back?

** edit ** Fourth - I am not protected by FMLA because I haven't been at my employer a year yet. If I actually end up losing my job due to the recovery, will they be at fault? nvm - not an issue. Told by boss job is safe. **
