insurance claim

hi I got into an accident over the long weekend and I think insurance is trying to screw me. unfortunately I couldn't wait for the police to arrive because it was already late and it would have been a 4 hour wait. so what happened was I was at a stop sign and I rolled forward after making my stop so I can check for traffic. this idiot comes barreling down the road and makes his left turn in the wrong lane and crushes my front end. his insurance is telling me I'm at fault because I had a stop sign but he was on the wrong side of the road shouldn't be be at fault? I live in Edmonton, alberta if that makes a difference for anything. thanks in advance.
