Prorating rent for non-access to unit
EDIT: The reason for the question is: this company promises 24/7 access for emergency and she had to spend a night out of the unit because they didn't keep that promise.
Yesterday someone mistook my girlfriend's apartment for their own and (probably while hammered) broke their key off in her lock. Unfortunately we didn't discover it until returning from a dinner party at 11:30 PM.
The 24/7 emergency line rang to voicemail because the company's contact is out of town on vacation. We were unable to get in contact with anyone from the company until this morning.
We also were unable to get a locksmith out to the unit until this morning.
Finally at 2 AM we filed a police report and went to my place.
I am curious if:
TL:DR
WE CAN DOCK 1 NIGHT'S RENT FROM HER MONTHLY RENT BECAUSE WE WERENT ABLE TO ACCESS THE UNIT.
