Background

In light of the P-C Relief Motion, the topic of RH's whereabouts between 10/31/2005 and 11/09/2005 have become very topical. A critical period of time that is under the microscope is 7:30pm to 8:30pm on 11/03/2005, when Steven and Chuck went to Menards and KZ's motion suggests that this was the window to steal blood from Steven's bathroom sink.
 

Possible alibi for RH on 11/03 during Menards Trip

Some have offered RH a possible alibi for this time, based on Inv. MW's report of his visit to TH's home on 11/03/2005 (CASO 5-8). In particular, the report says that SB and some of TH's friends were at the house and printed out the phone report that RH later testified that he had obtained from the Cingular web site:

It should be noted SCOTT and several of TERESA's friends had also arrived at the scene at that time. They did print us a copy of TERESA's cell phone activity from TERESA's computer. It should be noted TERESA would use CINGULAR WIRELESS as her cellular phone provider.

 
We know that Inv. WM states in his report that he was making phone calls at the office until just after 6:00 pm so its likely that he was at TH's home no earlier than 6:15 pm, and if RH was one of the friends at the home, then he may well have an alibi.
 

Inv. MW interviews RH later in the CASO

However, on page 31 of the CASO, that very same Inv. MW revisits TH's home on 11/04/2005 and finds and interviews RH.

Upon arrival, I met with RH along with several other friends who were at her residence. RH stated the last time he had seen TH was on Sunday, 10/30/05.

 
In this report, Inv. MW makes no statement suggesting that RH had been present the day before during his visit to the house.
 

Suggestive that RH was not there on 11/03/2005

Because the same detective visited the house both nights, and in the 11/04/2005 report, he does not mention seeing RH the night before, it is suggestive that RH was not there when he visited on 11/03/2005.
 
Apparently RH was there earlier on 11/03/2005, hacked the phone records, perhaps made some phone calls to identified numbers as reported by Auto Trader, and left the house. Other friends reprinted these numbers for police, when Inv. MW visited.
 

So is it an alibi, or is it more evidence of his absence. The investigation continues...
