[NC] Labor/OSHA Violations?

I work for [Large Pool Management Conglomerate] as a Manager/Lifeguard and I've got a few questions pertaining to employment and some tasks which we do.

  • We currently have at least 3 out of 20 (15%) lifeguards employed who do not have an active certification (due to expiring) who are left on the schedule at my facility (just one out of many managed by this company) by the management company. The [Large Pool Management Conglomerate] have been notified that these lifeguards are working without active certifications (by the lifeguards themselves) but any inquiries into re-certification have been met by silence.

  • We are required to handle Muriatic Acid, also known as Hydrochloric acid, with a Concentration by Weight of 31.45% (Classified as "Corrosive" according to Wikipedia and a "toxic substance" by the EPA). On-site we do not have a Safety Data Sheet for this acid nor have we ever had any training on dealing with the acid. Additionally we are not provided any sort of safety equipment for handling it. (Please note lifeguarding is a job where most guards are wearing very minimal clothing, usually just a swimsuit.)

  • We are required to handle "Accutab Blue". This consists of Calcium Hypochlorite, Calcium Chlorate, Calcium Carbonate, and Calcium Hydroxide (Classified as "Corrosive" according to the MSD found online). As with the Muriatic Acid we have no on-site Safety Data Sheet, no training to handle, and no safety equipment to handle it with.

  • Additionally we have minors handling both of these chemicals daily.

  • Storage of the "Accutab Blue" and Muriatic Acid: Both are stored either outside behind an unlocked gate or within our "pump room" (indoors but damp and no climate control).

Thank you for your time/help!
