PLDT not refunding downtime in service. Anyone else experience this? Why no class action?
I've been an expat in the philippines for 5 years now, so I'm accustomed to the way business works here and just accept it. However lately the situation with PLDT has been getting out of hand.
I'm on a 1600/mo DSL connection, and sometimes have downtime with the Internet and telephone line usually ranging from 12-24 hours. This usually occurs once or twice a month or so. In addition I have sporadic disconnections. I accept all this as part of the infrastructure here, and I have no problems with it. A tech came to my place and looked at the lines, multiple tests, everything is fine etc. I expected as much, I'm completely cool with this.
Here is my issue however: Last year I requested a refund since the Internet was down for 3 days straight that time, and I thought enough is enough. I called up to complain and they said they'd give me a "partial refund" for the days the Internet was down (this is unusual coming from australia where the service providers will give a free courtesy full month refund on the next billing cycle for the trouble caused). Nevertheless, I never received even this small partial refund.
Since I had to be put on the phone for over two hours over several days (most of this waiting time to connect to someone, and also mysterious disconnections from the live support personnel), I thought I'd just forget about it. Again I accept it as part of using services in the philippines, no problems. I dislike other expats who expect things to run like they do in their home country, I'm not one of them. However there must be a limit somewhere to how much these companies screw people over surely..
Now, 2 months ago for 1 entire week my landline was down. It just had a permanent "engaged" signal. I reported it within 24 hours but the tech arrived a week later, by which time it already resolved the day before. I thought.. enough is enough. Called again, explained that I never received my last refund (they said they didn't have a record of that request since it was over 12 months ago), but promised me this time a partial refund would go through for the week that my land line (not Internet) was down.
I received my bill last month, no adjustments made. I called, they said according to my reference number I reported a downtime of 1 day, and would be eligible for a 30php deduction subject to management approval. I had to create another report clarifying it was 1 week that I had downtime and not 1 day. Again, they promised the partial refund would go through (it only amounted to some 180php or so, but out of principle I thought I'd follow this up).
Next billing cycle came, still for the usual 1600php. Called again, they said this partial refund is still subject to management approval. Now, threatened with disconnection for not yet paying my bill this month, I refuse to do so until the 1600php has at least SOME amount deducted from it for the outage 2 months ago.
Now I hardly believe I'm the only one who has experienced these issues with partial refunds, and the fact they don't seem to actually get deducted from future bills. I love the culture here, I love how people don't become stressed by minor things, but I hate seeing exploitation like this by big companies all the time. So I have 3 questions -
- Who else has experienced this?
- Why haven't filipinos banded together to commence a class action against this sort of illegal behaviour? There seems to be many others with similar stories of being billed for services not rendered. People here should not have to pay for the days that a service is not provided.
- How do filipinos feel about amending the Filipino First policy (what I like to call the "oligarchy first" policy) to allow foreign companies to compete here? I remember in australia that Telstra was planning to compete here but pulled out. This is a company that in australia will usually credit an entire month free refund if a customer experiences untoward downtime, even for the days the service is working.
I'm ready to sue even if I lose money, if by doing so I can make life better here for others. But I want others experiencing the same issues of partial refunds not being credited to at least join me in a class action. I understand the courts may be rigged, but some stand needs to be made. These companies cannot be allowed to continue like this and Duterte's promises to fix them seem to have failed thus far.
