TX - The other party in the accident may have wrongfully been given a ticket.
A few months ago I was turning left at an intersection and was hit by a driver in the lane to the left of me (they were going straight). My car was pushed all the way under the underpass that I was turning under and across the five lanes of traffic on the other side of the underpass. I was under the impression that the other drivers lane was turn only and my lane was turn or go straight. The car I was behind also turned left. Two police officers witnessed the accident and gave the other driver a ticket for going straight in a turn only lane. My car was totaled and had to be towed from the site. Hers was still drivable but she had it towed as well. After the accident we both spoke with the police officers. She said everything was okay and that she wasn't hurt. I said I wasn't either. The next day I went to the ER to get checked out because I was so sore and just wanted to be safe. They did X-Ray and scans and everything was good. Her insurance company also accepted fault that day. --- five days later I get a call from her insurance company saying that they investigated the scene and that I was at fault for the accident. This left me with my ER bill and a 800 dollar bill to get my car towed off of the lot it was taken to. A few days after that I get a call from MY insurance company saying that she was taking a claim out against me because her wrist was injured. My insurance denied liability and the case was taken to arbitration. This was 4ish months ago and I cannot get any answers from my insurance company. I've since switched but I'm under the impression that they're still supposed to help me since they were my providers at the time.
Her insurance company may be right and myself, the officers, and the other driver that I was following may be in the wrong. We were at the ONLY point of the entire intersection that didn't have signs or any arrows painted on the ground. Every other point of the intersection had the same amount of lanes and two lanes that you could legally turn left in. However, mine didn't have a sign so I think technically only her lane could turn.
Today I received (via mail) a subpoena to testify as a witness because she's disputing her ticket.
Should I just go and say yeah? It was probably my fault?
Also it's "to the chief of police, Marshall, or any police officer, H, Texas - greetings you are hereby commanded to summon (my name) to blah blah court date and location. " Shouldn't the subpoena be addressed to me? not the chief officer? Also it didn't come via certified mail. There's no request for any documents in return?
I'm sorry this is so long and that there are so many parts to it. I don't want her to get in trouble for something I may have done wrong.
