[MA] Wrongful termination over injury?
Not sure if this can be considered wrongful termination or not, but here goes:
So back in April I was hired to work at a restaurant (big chain place) as a server/bartender. I was scheduled to start my training in early May. The morning of I called in to clarify a uniform question and they told me I was already late. I had mixed up the time by an hour. I apologized and said I'd be in as soon as possible.
I go in. Get there ~45ish minutes late thinking I'm going to get fired before even starting. Shit. I talk to the manager for about half an hour and he tells me that it is okay, things happen, and that I won't be fired for my stupid mistake. He tells me that since the shift has already started I should just go home and come in to start training tomorrow.
I'm just glad I wasn't fired at this point.
Later that same day, I ended up fracturing my hand (4th metacarpal) and I have to call in and say I won't be able to work. I said it shouldn't be too long, which is what they told me in the ER, so they pushed my start date back a week. A few days later when I went to a hand specialist I was put in a cast for 6 weeks that prevented me from doing much of anything with my right hand (dominant hand) so I emailed my boss and told her what was up.
I was told to get in touch "when everything is settled" and I am "absolutely" able to start training. Fast forward to me getting my cast off. I email my boss again and I am told that "due to the nature of how you started here..." I no longer have a job.
I was fully employed as I had filled out all necessary paperwork and during the period of time I was in the cast I even received a check in the mail for my "orientation day" (which was before the 1st training day).
Any insight is appreciated, thanks.
