Would you theoretically support SCOTUS upholding an executive order banning immigration from all countries excluding those with Muslim-majorities?
Proponents of the travel ban assert that the lower courts have not erred in their decisions. Rather, they argue that the order itself is effectively indisputable as (1) the executive enjoys unchecked powers when it comes to implementing immigration policy, and (2) non-citizens have no constitutional rights and thus no legal standing.
In light of this, theoretically, would you expect the courts to uphold an executive order by any subsequent POTUS that bars immigration from all countries excluding those of Muslim-majority countries?
