[IL] Police/State Atty. holding my motorcycle in impound. Charges have been dropped and it has been 10 weeks so far.

I was arrested for felony fleeing and eluding when a cop tried to pull me over and I didn't hear or see him. It was stupid and I've had my day in court, with all charges dropped except for 1 speeding ticket and 1 improper lane change, and I was given court supervision for both after paying about $1k in fines.

My motorcycle was impounded and the Sheriff filed paperwork to seize it on the felony charge. On the day of court the state's attorney told my lawyer that there is still a hold on the bike and that he was still determining whether to proceed with the civil lawsuit that is required for the state to seize it. I understand how that works and that it is up to my lawyer to fight that battle if/when the time comes.

My questions are:

  • How long can the state's attorney just sit on my property? It has been 10 weeks already.
  • I'm accruing $25/day in impound fees. If I beat the state in my case, or they decide to give my bike back, how much of that do I have to pay? It won't be much longer and the impound fees will exceed the value of the bike, so I'm getting quite anxious.
  • If the state's attorney decides not to proceed with the lawsuit, will I get a letter or something? Should I be checking with the impound lot every once in a while to see if the hold has been released?
