Company I wrote a bad review for sent cease and desist letters into my former and current employer [Colorado]
Hello,
I wrote a bad review for a company I disliked a couple months ago. Since then, another person has created a smear campaign on social media which includes various YouTube videos, posts, etc. The company had hired a law firm to find this person.
The law firm originally reached out to me on an old email I never used, so I didn't get the message. A week later, I went to check my old email, as I do from time to time, and I finally saw the first message, as well as a second. The first contained an original cease and desist letter saying they have "credible information" from "reliable sources" that I was behind the smear campaign. After eventually speaking with the law firm, this "credible information" was that my review sounded somewhat like the language in the smear campaign videos, and that I worked in tech, and they assumed I had the knowledge to make videos, etc.
The second email, after I continued to read, included 3 attachments. 1 letter they sent to me saying they were going to take legal action against me because I did not remove the videos, posts, etc. The 2nd and 3rd were letters to my former and current employer that were sent via email and postal service claiming I was behind the campaign, and that they should refrain from deleting any files on my company computers as they believe I utilized company equipment to create the videos. These letters also made large assumptions that I was behind the campaign, and they claimed I was the perpetrator to these crimes, saying they conducted an investigation and found it was me. This goes back to their "credible information" from "reliable sources" excuse, which, to me, is not reliable information from any credible sources. When I reached out to the lawyer, I asked why they didn't contact Google or YouTube or Facebook and they basically said they didn't want to spend money to file a subpoena to get the contact info of the right person.
I immediately called the law firm to show them it wasn't me. They quickly realized it wasn't. I was out of the country when a lot of the content was posted, and my voice did not match up with the voice of the creator of the videos. They quickly backed off, but the letters had already been sent.
These letters have really damaged my image. My former employer feels very threatened by the law firm, and clearly is displaying distrust with me. My current employer kinda laughed it off, but it was my first week on the job, and this was very hard for me. I have spent the last couple days very depressed, questioning my character, scared, and have had multiple panic attacks. This was a bombshell for me, and it hit my psyche very hard. From my conversations with the firm, it was a lot of, "we can do whatever we want", "it's not my job to protect your career", and "these are the consequences for talking bad about a company online". I feel very powerless and affected by how aggressive and rude and careless of my life and well being the lawyer was. I feel that in the process of this law firm trying to pin someone else for defamation, they defamed me by accident.
They did follow up to both my current employer and former employer, however the letter to my former employer was much less clear. For my current employer, they basically said it's not me, he has committed to helping us answer questions, but we believe he is sincere in his denial of creating the videos, etc. For my former employer, it was much more like, don't delete anything in case we need to start an investigation, we don't think it's OP, but take precaution. The law firm said this was standard protocol to not delete anything until everything is over. They too said they think i'm sincere that it wasn't me, but it's clear my former employer is much much more hesitant.
I am not sure where to go from here. I am going into work tomorrow, and am hoping all is okay, however this all felt like very sloppy law, aggressive and very unethical. I am no lawyer, however, so I don't know what's legal or not. I am trying to remove my original review, as I want no association with this company. The problem is I was logged into my old company's email when I wrote it, so I don't have access right now to delete it, and they won't give me access until the law firm says they are in the clear. The law firm told me the google review was not their concern for this investigation, but I want to delete it anyway.
Is there any course of action I should take? Anything helps here. Thank you.
Edit: Is there anything I can tell my former employer to ease up their tensions?
